Terms of Use

1. Agreement
These Terms of Use govern your use of offthegridstudios.com and its subdomains (the “Site”), operated by Off the Grid Studios, Bend, Oregon, United States. By using the Site you agree to them. If you do not agree, please do not use the Site.
Purchases from our merchandise store (at offthegridstudios.com) are additionally governed by our Shipping & Returns policy and by the terms of the store platform on which the sale takes place.
2. Our content
The films, trailers, photographs, footage, artwork, text, designs, logos and the selection and arrangement of everything on this Site are owned by Off the Grid Studios or its licensors and are protected by United States and international copyright and trademark law. “Off the Grid Studios” and our logos are our trademarks.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view and stream the free films on this Site for your own private, non-commercial enjoyment. That is it. Without our prior written permission you may not copy, download, rip, re-upload, screen publicly, broadcast, sublicense, sell, distribute, or make derivative works from any of it, and you may not use any of it to train, fine-tune or otherwise develop a machine-learning or generative AI model.
Purchased digital films are licensed to you for personal viewing only, not for resale, redistribution, public exhibition, or commercial use. Public screening, festival, broadcast and licensing enquiries are welcome — talk to us, we are friendly about it.
3. Anything you send us
If you send us a pitch, footage, an idea, a comment or any other material, you confirm it is yours to send and that it does not infringe anyone else’s rights. You keep ownership. You grant us a non-exclusive, royalty-free, worldwide licence to use it for the purpose you sent it for. We may already be developing something similar, and nothing in this section obliges us to keep an unsolicited idea confidential or to compensate you for it.
4. Acceptable use
Do not use the Site to break the law, infringe anyone’s rights, transmit malware, attempt to gain unauthorised access to our systems, interfere with the Site’s operation, or scrape, crawl or harvest content or contact details by automated means without our written permission.
5. Third-party links and services
The Site links to and embeds third-party services, including YouTube and our Shopify store. We do not control them and we are not responsible for their content, practices or policies. Their terms and privacy policies apply when you use them.
6. Disclaimers
The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any information on it is accurate or complete. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
7. Limitation of liability
To the fullest extent permitted by law, Off the Grid Studios and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of the Site, however caused and on any theory of liability. Our total aggregate liability arising out of or relating to the Site or these Terms will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars (US$100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence or for fraud. If you are a consumer in the EU or the UK, your statutory consumer rights are unaffected by these Terms.
8. Indemnity
You agree to indemnify and hold Off the Grid Studios harmless from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your infringement of any third party’s rights.
9. Copyright complaints (DMCA)
We respect copyright and expect the same. If you believe material on this Site infringes your copyright, send a written notice under 17 U.S.C. § 512(c)(3) to our designated agent that includes: your physical or electronic signature; identification of the work claimed to be infringed; identification of the material you say is infringing and enough detail for us to find it; your contact details; a statement that you have a good faith belief the use is not authorised by the copyright owner, its agent or the law; and a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner’s behalf.

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice under 17 U.S.C. § 512(g)(3) to the same agent. We terminate the accounts of repeat infringers in appropriate circumstances. Knowingly making a false claim of infringement can make you liable for damages under 17 U.S.C. § 512(f).

11. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of laws rules. You and Off the Grid Studios agree to the exclusive jurisdiction of the state and federal courts located in Deschutes County, Oregon for any dispute arising out of these Terms or the Site.
Before filing anything, please email us — almost everything gets sorted out that way. If you are a consumer resident in the EU or the UK, this clause does not deprive you of the protection of the mandatory laws of your country of residence or of your right to bring proceedings there.
12. General
If any provision of these Terms is held unenforceable, the rest remains in effect and the unenforceable provision is modified to the minimum extent necessary to make it enforceable. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between us regarding the Site. We may update these Terms; the effective date at the top will change and material updates will be flagged on the Site.
